Terms of Service

These Terms of Service ("Terms") govern your use of Bnome, operated by IdeaDLT (a sole proprietorship registered in Israel, trading as Bnome). By using bnome.com (the "Service"), you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement.

3. Description of Service

Bnome is an AI platform that builds and runs software for a business from plain-language descriptions: programs with their own pages, data and background work, published at their own addresses and connected to the other services you authorize. It also makes images, video, music and transcripts, and can be driven from external AI agents through our MCP connector.

4. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to use the Service to:

Build or distribute anything illegal, harmful, fraudulent, or infringing.
Violate the rights of others, including intellectual property and privacy rights.
Distribute malware, spam, or engage in phishing or abuse.
Host phishing pages, impersonate others, or collect passwords or payment details by deception.
Send unsolicited messages through email or connected accounts.
Use the Service against the usage policies of the AI providers behind it, including Anthropic's Usage Policy.
Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.
Resell or misrepresent the Service without authorization.

We may disable or remove a program that breaks these rules, without notice when that is needed to protect others. Report abuse to abuse@bnome.com.

6. AI-Generated Content

The Service generates code and applications using AI. AI output may contain errors, insecure patterns, or unexpected behavior. You are responsible for reviewing, testing, and securing any application you build and deploy. We provide no warranty that generated content is fit for a particular purpose.

7. Intellectual Property

You own the applications and content you create with the Service, subject to the rights of third-party dependencies. We retain all rights to the Bnome platform, brand, and underlying technology. You grant us a limited license to host, process, and display your content solely to operate the Service.

8. Payments & Subscriptions

Paid plans and credit packs are sold by Polar Software, Inc., our reseller and Merchant of Record, under Polar's Buyer Terms, which govern the payment; these Terms govern your use of the Service. Subscriptions renew automatically until cancelled. Prices are shown at checkout. See our Refund Policy for refund terms.

9. Credits

Building and changing programs, AI generation and transcription use credits. Plans include credits, and free accounts get a starting allowance. Credits have no cash value and cannot be transferred; what an action uses is shown in the Service. Programs in free spaces may sleep when nobody uses them and wake on the next visit.

10. Connected Accounts

When you connect another service to your programs, you authorize them to act on it as you instruct. You are responsible for what your programs do with it, and that service's own terms apply.

11. Third-Party Services

The Service relies on third parties, including Anthropic, KIE and AssemblyAI for AI, Composio for connected services, Supabase for sign-in, Resend for email and Polar for payments. Your use of their outputs is also subject to their terms. We are not responsible for third-party services.

12. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.

13. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the Service and delete your account at any time.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, IdeaDLT shall not be liable for any indirect, incidental, or consequential damages, or for lost profits or data. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless IdeaDLT from any claims arising out of your use of the Service, your content, or your violation of these Terms.

17. Governing Law and Courts

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts in Haifa, Israel have exclusive jurisdiction over any such dispute. If you use the Service as a consumer (for purposes outside your trade, business or profession), nothing in this section takes away the protection of the mandatory laws of the country where you live, including any right under those laws to bring a claim in, or to be sued only in, the courts where you live.
